Terms of Service

These Terms of Service ("Terms") govern your use of the Vibe Books website at www.vibebooks.co.uk and the Vibe Books application (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

Vibe Books is operated by a sole trader based in the United Kingdom.

1. The Service

Vibe Books is an online bookkeeping tool designed to help UK sole traders and landlords:

• Record income and expenses digitally
• Track financial data by tax year and quarter
• Submit quarterly updates and end-of-period statements to HMRC via the Making Tax Digital (MTD) for Income Tax API

2. Account registration

To use the Service, you must create an account by providing your name, email address and a password. You agree to:

• Provide accurate and complete information
• Verify your email address before accessing the Service
• Keep your password secure and not share it with anyone
• Notify us immediately if you suspect unauthorised access to your account

You are responsible for all activity that occurs under your account.

3. Free and paid plans

Vibe Books offers a free plan and paid subscription plans. Details of each plan and their features are described on our website.

• Free plan: Unlimited transaction tracking at no cost.
• Paid plans: Additional features including HMRC submissions, billed monthly or annually via Stripe.

Paid subscriptions renew automatically until cancelled. You may cancel your subscription at any time through the Service. Upon cancellation, you retain access until the end of your current billing period, after which your account reverts to the free plan.

All prices are in British Pounds (GBP) and inclusive of VAT where applicable.

4. Refunds

As the Service is delivered digitally, we do not generally offer refunds once a subscription period has begun. If you believe you have been charged in error, please contact us and we will review your case.

5. HMRC submissions disclaimer

Vibe Books facilitates the submission of financial data to HMRC through their Making Tax Digital API. However:

• You are solely responsible for the accuracy and completeness of the financial data you enter.
• Vibe Books does not verify, audit or validate your financial records.
• Vibe Books is not a substitute for professional accounting or tax advice. If you are unsure about your tax obligations, consult a qualified accountant.
• We are not responsible for any penalties, fines or consequences arising from incorrect, incomplete or late submissions to HMRC.
• Vibe Books is not affiliated with, endorsed by, or officially connected to HM Revenue & Customs (HMRC) or HM Government.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to access other users' accounts or data
• Reverse-engineer, decompile or otherwise attempt to extract the source code of the Service
• Use automated tools to scrape, crawl or overload the Service
• Upload malicious content, viruses or harmful code

We reserve the right to suspend or terminate your account if you breach these Terms.

7. Intellectual property

All content, design, code, logos and trademarks associated with Vibe Books are owned by us or licensed to us. You may not copy, reproduce or redistribute any part of the Service without our written permission.

Your financial data remains yours. We claim no ownership over the data you enter into the Service.

8. Account termination

• By you: You may delete your account at any time. This permanently removes all your data from our systems.
• By us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. We will notify you by email where possible.

9. Service availability

We aim to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates or circumstances beyond our control.

We are not liable for any losses resulting from downtime or service interruptions.

10. Limitation of liability

To the fullest extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special or consequential damages arising from your use of the Service.
• Our total liability to you for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or £50, whichever is greater.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Privacy

Your privacy is important to us. Please read our Privacy Policy to understand how we collect, use and protect your data.

12. Changes to these Terms

We may update these Terms from time to time. If we make significant changes, we will notify you by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
